TeachShare Platform Privacy Notice

Welcome to TeachShare, a platform that simplifies classroom workflows so educators can focus on what matters most – building relationships with their students. This Privacy Notice explains how WorksheetsAI Inc. d/b/a TeachShare (“TeachShare”) collects, uses, discloses, and otherwise processes personal data in connection with its platform, including related software, documentation, and online, mobile-enabled, and/or digital services.

This Privacy Notice does not address our privacy practices relating to TeachShare job applicants, employees and other employment-related individuals. This Privacy Notice also does not apply to data that is exempt from applicable data protection laws (such as deidentified or publicly available information).

This Privacy Notice is not a contract and does not create any legal rights or obligations not otherwise provided by law.

A note about Student Data: Our Service is intended for providers of educational services, such as schools and school districts (collectively, “Educational Institutions”), as well as teachers and authorized school users and administrators (collectively, “Teachers”). The TeachShare platform may be used by Teachers and Educational Institutions in a manner that does not collect personal data from or about students. When an Educational Institution or Teacher invites their students (“Students”) to use the Service as part of an Educational Institution’s educational curriculum, the personal data related to students that is (i) provided to TeachShare by an Educational Institution, or (ii) collected by TeachShare during the provision of the Service to an Educational Institution, may include information defined as “educational records” by the Family Educational Rights and Privacy Act (“FERPA”) or “covered information” under California’s Student Online Personal Information Protection Act (“SOPIPA”), or other information protected by similar student data privacy laws. We call this information “Student Data.”

Please see the “Student Data” section below to understand the principles which guide our collection, use and disclosure of Student Data.

Our Collection and Use of Personal Data

The categories of personal data we collect depend on how you interact with us and our services. For example, you may provide us your personal data directly when you register for an account on our service, send us messages, or otherwise interact with our services.

We also collect personal data automatically when you interact with our services and may also collect personal data from other sources and third parties.

Personal Data Provided by Individuals

We collect the following categories of personal data individuals provide us:

  • Contact Information, including first and last name, phone number, email address, mailing address, Educational Institution, and communication preferences. We use this information primarily to fulfill your request or transaction, and to communicate with you directly.
  • Account Information, including first and last name, email address, phone number, account credentials or one-time passcodes, and the services you are interested in, purchased, or have otherwise used. We use this information primarily to administer your account, provide you with our services, communicate with you regarding your account and your use of our products and services, and for customer support purposes.
  • Customer Content, including any files, documents, audio, videos, images, data, or communications you choose to input, upload, or transmit to our products and services. We use this content primarily to provide you with our products and services, to facilitate your requests, and to improve our products and services.
  • Payment Information, including payment card information, billing address, and other financial information (such as, routing and account number). Please note that we use third-party payment providers, including Stripe, to process payments made to us. We do not retain any personally identifiable financial information, such as payment card number, you provide these third-party payment providers in connection with payments. Rather, all such information is provided directly by you to our third-party payment providers. The payment provider’s use of your personal data is governed by their privacy notice.   • Feedback and Support Information, including the contents of custom messages sent through the forms, chat platforms, including our online live chat or automated chat functions, email addresses, or other contact information we make available to customers, as well as recordings of calls with us, where permitted by law (including through the use of automated tools provided by us or our third-party providers). We use this information primarily to investigate and respond to your inquiries, to communicate with you via online chat, email, phone, text message or social media, and to improve our products and services.

If you choose to contact us, we may need additional information to fulfill the request or respond to your inquiry. We may provide additional privacy disclosures where the scope of the request we receive or personal data we require fall outside the scope of this Privacy Notice. In that case, the additional privacy disclosures will govern how we may process the information you provide at that time.

Personal Data Automatically Collected

We, and our third-party partners, automatically collect information you provide to us and information about how you access and use our products and services when you engage with us. We typically collect this information through the use of a variety of our own and our third-party partners’ automatic data collection technologies, including (i) cookies or small data files that are stored on an individual’s computer and (ii) other, related technologies, such as web beacons, pixels, embedded scripts, mobile SDKs, location-identifying technologies and logging technologies. Information we collect automatically about you may be combined with other personal data we collect directly from you or receive from other sources.

We, and our third-party partners, use automatic data collection technologies to automatically collect the following data when you use our services or otherwise engage with us:

  • Information About Your Device and Network, including the device type, manufacturer, and model, operating system, IP address, browser type, Internet service provider, and unique identifiers associated with you, your device, or your network (including, for example, a persistent device identifier). We employ third-party technologies designed to allow us to recognize when two or more devices are likely being used by the same individual and may leverage these technologies (where permitted) to link information collected from different devices.
  • Information About the Way Individuals Use Our Services and Interact With Us, including how frequently you access our services, whether you access our services from multiple devices, and other browsing behavior and actions you take on our services (such as the pages you visit, the content you view, the communications you have through our services, and the content and links you interact with).
  • Information About Your Location, including general geographic location that we or our third-party providers may derive from your IP address.

All of the information collected automatically through these tools allows us to improve your customer experience. For example, we may use this information to enhance and personalize your user experience, to monitor and improve our products and services, to offer communications features such as live and automated chat, and to improve the effectiveness of our products, services, offers, communications and customer service. We may also use this information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit our services; (b) provide custom, personalized content and information; (c) identify you across multiple devices; (d) provide and monitor the effectiveness of our services; (e) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns; (f) diagnose or fix technology problems; and (g) otherwise to plan for and enhance our products and services.

Personal Data from Other Sources and Third Parties

We may receive the same categories of personal data as described above from the following sources and other parties:

  • Our Affiliates: We are able to offer you the products and services we make available because of the hard work of our team members across all TeachShare entities. To provide our products and facilitate our services, TeachShare entities receive personal data from other TeachShare entities for purposes and uses that are consistent with this Privacy Notice.
  • Single Sign-On: We may provide you the ability to log in to our services through certain third-party accounts you maintain, such as a Google account. When you use these single sign-on protocols to access our services, we do not receive your login credentials for the relevant third-party service. Instead, we receive tokens from the single sign-on protocol to help identify you in our system (such as by your username) and confirm you successfully authenticated through the single sign-on protocol. This information allows us to more easily provide you access to our products and services.
  • Educational Institutions: If you interact with our services through an Educational Institution, we may obtain personal data about you from the Educational Institution. For example, we may obtain your contact information to allow us to communicate with you about your use of our services.
  • Other Customers: We may receive your personal data from our other customers. For example, a customer may provide us with your contact information as part of a referral.
  • Service Providers: Our service providers that perform services on our behalf, such as analytics, collect personal data and often share some or all of this information with us. For example, we receive personal data you may submit in response to requests for feedback to our survey providers.
  • Other Sources: We may also collect personal data about you from other sources, including publicly available sources, third-party data providers, brand partnerships, or through transactions such as mergers and acquisitions.
  • Inferences: We may generate inferences or predictions about you and your interests and preferences based on the other personal data we collect and the interactions we have with you.

Additional Uses of Personal Data

In addition to the primary purposes for using personal data described above, we may also use personal data we collect to:

  • Fulfill or meet the reason the information was provided, such as to fulfill our contractual obligations, to facilitate payment for our products and services, or to deliver the services requested;
  • Manage our organization and its day-to-day operations;
  • Communicate with you, including via email, text message, chat, and/or telephone calls;
  • Facilitate the relationship we have with you and, where applicable, the company you represent;
  • Request you provide us feedback about our product and service offerings;
  • Address inquiries or complaints made by or about an individual in connection with our products or services;
  • Create and maintain accounts for our users;
  • Verify your identity and entitlement to our products and services;
  • Register you for and provide you access to events, contests, sweepstakes, and surveys;
  • Administer, improve, and personalize our products and services, including by recognizing you and remembering your information when you return to our products and services;
  • Develop, operate, improve, maintain, protect, and provide the features and functionality of our products and services;
  • Identify and analyze how you use our products and services;
  • Infer additional information about you from your use of our products and services, such as your interests.
  • Create aggregated or de-identified information that cannot reasonably be used to identify you, which information we may use for purposes outside the scope of this Privacy Notice;
  • Conduct research and analytics on our user base and our products and services, including to better understand the demographics of our users;
  • Improve and customize our products and services to address the needs and interests of our user base and other individuals we interact with;
  • Test, enhance, update, and monitor the products and services, or diagnose or fix technology problems;
  • Help maintain and enhance the safety, security, and integrity of our property, products, services, technology, assets, and business;
  • Defend, protect, or enforce our rights or applicable contracts and agreements (including our Terms of Service), as well as to resolve disputes, to carry out our obligations and enforce our rights, and to protect our business interests and the interests and rights of third parties;
  • Detect, prevent, investigate, or provide notice of security incidents or other malicious, deceptive, fraudulent, or illegal activity and protect the rights and property of TeachShare and others;
  • Facilitate business transactions and reorganizations impacting the structure of our business;
  • Comply with contractual and legal obligations and requirements;
  • Fulfill any other purpose for which you provide your personal data, or for which you have otherwise consented.

Our Disclosure of Personal Data

We disclose or otherwise make available personal data in the following ways:

  • To Our Affiliates: We are able to offer you the products and services we make available because of the hard work of our team members across TeachShare entities. To provide our products and facilitate our services, TeachShare entities disclose personal data to other TeachShare entities for purposes and uses that are consistent with this Privacy Notice.
  • To Your Educational Institution: If you interact with our services through an Educational Institution, we may disclose personal data to the Educational Institution. For example, we may provide information to your employer about your usage of our services in connection with your work for them.
  • To Other Customers and the General Public: We make available personal data designed for sharing through our services with certain or all other TeachShare customers, or the general public, based on the applicable privacy settings and intended recipients. Keep in mind that the customers who view customer-generated content can always reshare or redistribute the content both on and off our services or save or copy the content outside of our services. In addition, by publicly posting content on our services, you are directing us to disclose that information as broadly as possible and directing those accessing the content to do the same.
  • To AI Service Providers: We share personal data with service providers who enable us to provide AI-powered services. For example, this may include services who assist us in providing the AI-powered auto-grading feature that forms part of our services. Our current list of service providers is available upon request. As required by applicable data protection laws, we impose contractual limits on how these service providers can use the personal data they receive.
  • To Service Providers: We engage other third parties to perform certain services on our behalf in connection with the uses of personal data described in the sections above. Depending on the applicable services, these service providers may process personal data on our behalf or have access to personal data while performing services on our behalf. As required by applicable data protection laws, we impose contractual limits on how these service providers can use the personal data they receive.
  • To Other Businesses as Needed to Provide Services: We may share personal data with third parties you engage with through our services or as needed to fulfill a request or transaction including, for example, payment processing services.
  • In Connection with a Business Transaction or Reorganization: We may take part in or be involved with a business transaction or reorganization, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose, transfer, or assign personal data to a third party during negotiation of, in connection with, or as an asset in such a business transaction or reorganization. Also, in the unlikely event of our bankruptcy, receivership, or insolvency, your personal data may be disclosed, transferred, or assigned to third parties in connection with the proceedings or disposition of our assets.
  • To Facilitate Legal Obligations and Rights: We may disclose personal data to third parties, such as legal advisors and law enforcement:
    • in connection with the establishment, exercise, or defense of legal claims;
    • to comply with laws or to respond to lawful requests and legal process;
    • to protect our rights and property and the rights and property of our agents, customers, and others, including to enforce our agreements, policies, and terms of use;
    • to detect, suppress, or prevent fraud;
    • to reduce credit risk and collect debts owed to us;
    • to protect the health and safety of us, our customers, or any person; or
    • as otherwise required by applicable law.
  • With Your Consent or Direction: We may disclose your personal data to certain other third parties or publicly with your consent or direction. For example, with your permission, we may post your testimonial on our websites.

Your Privacy Choices

The following privacy choices are made available to all individuals with whom we interact.

Communication Preferences

  • Email Communication Preferences: You can stop receiving certain email communications from us by clicking on the “unsubscribe” link provided in any of our email communications. Please note you cannot opt-out of service-related email communications (such as, account verification, transaction confirmation, or service update emails).
  • Direct Mailing Preferences: You can stop receiving promotional direct mail communications from us by contacting us at hey@teachshare.com. Please note this opt-out does not affect any mailings that are controlled by third parties that may feature or mention our services.

Withdrawing Your Consent

Where we have your consent for the processing of your personal data, you may withdraw your consent by following the instructions provided when your consent was requested or by contacting us as set forth in the Contact Us section below.

Automatic Data Collection Preferences

Where a TeachShare-specific preference manager or privacy setting is not available, you may be able to utilize third-party tools and features to further restrict our use of automatic data collection technologies. For example, (i) most browsers allow you to change browser settings to limit automatic data collection technologies on websites, (ii) most email providers allow you to prevent the automatic downloading of images in emails that may contain automatic data collection technologies, and (iii) many devices allow you to change your device settings to limit automatic data collection technologies for device applications. Please note that blocking automatic data collection technologies through third-party tools and features may negatively impact your experience using our services, as some features and offerings may not work properly or at all. Depending on the third-party tool or feature you use, you may not be able to block all automatic data collection technologies or you may need to update your preferences on multiple devices or browsers. We do not have any control over these third-party tools and features and are not responsible if they do not function as intended.

Modifying or Deleting Your Personal Data

If you have any questions about reviewing, modifying, or deleting your personal data, you can contact us directly at hey@teachshare.com. We may not be able to modify or delete your personal data in all circumstances.

Partner-Specific Preferences

Certain of our third-party providers and partners offer additional ways that you may exercise control over your personal data, or automatically impose limitations on the way we can use personal data in connection with the services they provide:

  • Device-Specific / Platform-Specific Preferences: The device and/or platform you use to interact with us (such as your mobile device), may provide you additional choices with regard to the data you choose to share with us. For example, many mobile devices allow you to change your device permissions to prevent our products and services from accessing certain types of information from your device (such as your contact lists or precise geolocation data), and many social media platforms allow you to change your platform permissions to prevent integrated products and services from accessing certain types of information connected with your profile.
  • Google Analytics: Google Analytics allows us to better understand how our customers interact with our services. For information on how Google Analytics collects and processes data, as well as how you can control information sent to Google, review Google's website here: https://www.google.com/policies/privacy/partners/. Children’s Privacy

TeachShare does not direct its Services to children under 13 or knowingly collect personal data from children under 13, unless and except when an Educational Institution allows a child to participate in the Institution’s use of the platform services with appropriate consent or authorization, as follows:

  • TeachShare provides services on behalf of Educational Institutions. The Educational Institution provides consent for TeachShare to collect information from Students under the age of 13 through the services provided on the Educational Institution’s behalf, as permitted by the Children’s Online Privacy Protection Act (“COPPA”) and other applicable data privacy laws. In this case:
    • We collect and process personal data from Students under 13 solely at the direction of and under the control of an Educational Institution, and do not require Students to disclose more information than is reasonably necessary to use our services. For example, Students may be assigned a pseudonym for a given assignment when they use our services.
    • At all times, Educational Institutions have the right to request to review or delete the personal data from Students under 13 or decline to permit further collection or use of the Students’ personal data by contacting the Educational Institution’s account representative.
    • Educational Institutions are responsible for providing appropriate notice to parents or legal guardians (each, a “Parent”) of the Educational Institution’s use of third-party service providers such as TeachShare. We recommend that Educational Institution customers provide a link to this Privacy Notice to all Parents.
    • For more information on how we collect and process Student Data, please see the section on Student Data below.
    • The Parent or Educational Institution may withdraw consent at any time.

Data Collected from Children

When a child under 13 uses our services, we will collect the following information from the child:

  • Information Collected Through the Use of our services, including any files, documents, videos, images, or other information the child chooses to provide through the child’s use of our services.
  • Student-related Information, such as topics of study, assignments and content (e.g., homework), and grades.
  • Usage information, such as date/time of visit, time spent on our Service, time zone, and activities completed or engaged with through our services.
  • Device data and log files, which could include IP address, operating system, device type and version, browser type and version, browser ID, and location data derived from an IP address. This information is typically collected through cookies or similar technologies and we may use third-party providers to collect this information on our behalf. We collect this information to help us understand usage, to diagnose problems and provide support, to administer our Service, facilitate navigation, display information more effectively, to remember users’ settings and preferences, to personalize the user’s experience while using our services, and to recognize a user’s computer or device to assist in the use of our services and for security purposes.

We do not require the child to provide any more information than is reasonably necessary to use our services.

How We Share or Disclose a Child’s Personal Data

We share or disclose a child’s personal data as needed to provide our services or with third parties with appropriate consent or authorization. For example, we share a child’s personal data with third parties as authorized by the Parent or the Educational Institution, such as Educational Institution administrators, counselors, resource professionals and others subject to appropriate authorization. Similarly, children may communicate with others through our services subject to appropriate authorization, such as with their Teachers. Users are not permitted to interact with other untrusted users.

We also share information with our trusted third-party service providers who provide services to us or on our behalf, such as website hosting and customer support services, information technology and related infrastructure provision, and other services.

Our current list of service providers is available upon request. As required by applicable data protection laws, we impose contractual limits on how these service providers can use the personal data they receive.

We may also share personal data if we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, our users or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. If TeachShare becomes involved in a merger, acquisition, bankruptcy, change of control, or any form of sale of some or all of its assets, a child’s personal data may be transferred or disclosed in connection with the business transaction, subject to any applicable laws.

We may also share aggregate or de-identified information in a manner that cannot be reasonably used to identify an individual user.

How to Access and Delete a Child’s Personal Data

A Parent has the right to access the personal data we have collected from the child, withdraw consent for further collection and request deletion of the child’s personal data. If you are a Parent of a Student under 13 using our services through an Educational Institution and you want to access, correct, or delete the Student’s personal data, please contact your child’s Educational Institution to submit your request. We will respond to the Educational Institution’s instructions with respect to your child’s personal data.

Unless we receive a deletion request, we will retain the personal data collected from the child for as long as necessary to provide our services and comply with our legal obligations, which could include retaining information as needed for recordkeeping and billing obligations. We will delete and/or de-identify the child’s personal data when it is no longer needed for the purposes for which it was collected.

If you require additional assistance regarding your child’s personal data, please contact us at hey@teachshare.com. We will respond to all requests as soon as possible. For requests that relate to Students, we may be required to refer the request to the Educational Institution’s administrator team for action.

If you believe a child under the age of 13 has provided personal data to us other than as described above, please contact us using the information in the Contact Us section below so that we may delete such information.

Student Data

Teachers and Educational Institutions may use TeachShare in a manner that does not require the collection of any personal information from or about Students, although not all features of the platform may be available. When a Teacher or Educational Institution invites Students to participate in the Institution’s use of the platform services, we may collect personal data related to Students that is (i) provided to TeachShare by the Educational Institution, or (ii) collected by TeachShare during the provision of the services to an Educational Institution (“Student Data”). Student Data may include information defined as “educational records” by FERPA or “covered information” under SOPIPA, or other information protected by similar student data privacy laws.

If you are a Teacher who allows Students to use our services in an educational setting, and your Educational Institution has not entered into a separate student data processing agreement with TeachShare, please note that the TeachShare Student Data Processing Addendum applies to your use of the Service. Our collection and use of Student Data is governed by our contracts with the Educational Institution customer and applicable privacy laws. The following generally describes how we process Student Data on behalf of an Educational Institution:

  • As between us and the Educational Institution, Student Data is owned and controlled by the Educational Institution.
  • We provide services to Educational Institutions as a “School Official” under FERPA.
  • We collect, maintain, use and share Student Data only for an authorized educational purpose and as described in our agreement with the Educational Institution, or as directed by the Educational Institution or by the Student’s Parent.
  • We do not use or disclose Student Data for targeted advertising purposes.
  • We do not build a personal profile of a Student. For example, Students may be assigned a pseudonym for a given assignment when they use our services.
  • We maintain a comprehensive data security program designed to protect the types of Student Data maintained by the Service.
  • We will clearly and transparently disclose our data policies and practices to our users.
  • We will never sell Student Data unless the sale is part of a corporate transaction, such as a merger, acquisition, bankruptcy, or other sale of assets, in which case we will require the new owner to continue to honor the terms provided in this Privacy Notice or we will provide the Educational Institution with notice and an opportunity to opt-out of the transfer of Student Data by deleting the Student Data before the transfer occurs.
  • We will not make any material changes to our Privacy Notice or contractual agreements that relate to the collection or use of Student Data without first giving notice to the Educational Institution and providing a choice before the Student Data is used in a materially different manner than was disclosed when the information was collected.

How We Share and Disclose Student Data

  • We disclose Student Data solely as needed to provide the service on behalf of specific Educational Institutions in accordance with our contracts with those Educational Institutions or with the consent of the Educational Institution or Parent.
  • For example, Student Data and account usage data may be disclosed to or accessible by users who are authorized to use the service on behalf of the Educational Institution, such as a school or district administrator. In addition, depending on the manner in which TeachShare is used by the Educational Institution and the terms of the agreement between the Educational Institution and TeachShare, we may provide access to certain Student Data to the Student and/or to the Parent of the Student about whom the data relates, for the purpose of monitoring Student usage and activity and evaluating the effectiveness of the Educational Institution’s use of the Service.
  • We also disclose Student Data to trusted service providers who have a legitimate need to access such information on our behalf, subject to appropriate contractual terms to protect such data. Our current list of service providers is available upon request.
  • We may also disclose Student Data in connection with a business transaction or to support our legal rights and obligations, as described in the Our Disclosure of Personal Data section of this Privacy Notice.

How We Use De-Identified Data

We may also generate, use, and disclose de-identified information for adaptive learning purposes or customized student learning purposes, to recommend content or services relating to Educational Institutional purposes or other educational or employment purposes, as well as for development, research and improvement of our services. In addition, we may use de-identified information for the development and improvement of other educational sites, services and applications or technologies more generally to the extent permitted under applicable law. “De-identified information” means data from which all personally identifiable information has been removed or obscured so that the remaining information does not reasonably identify an individual and there is no reasonable basis to believe that the information can be used to identify an individual.

How We Retain Student Data

We will not knowingly retain Student Data beyond the time period required to support an educational purpose, unless authorized by the Educational Institution.

Please note: Educational Institutions are responsible for maintaining current class rosters, and for managing Student Data which they no longer need for an educational purpose by submitting a deletion request.

If you are using our services on behalf of an Educational Institution and wish to access Student Data, delete Student Data or close your account, please contact us (hey@teachshare.com). If you are a Parent or Student and wish to access Student Data, delete Student Data or close your account, please direct your request to your Educational Institution.

If you are a Parent or Student and have questions about specific practices relating to Student Data provided to TeachShare by an Educational Institution, please direct your questions to your Educational Institution.

Third-Party Websites and Services

Our services may include links to third-party websites, plug-ins, applications and other services. Except where we post, link to or expressly adopt or refer to this Privacy Notice, this Privacy Notice does not apply to any personal data practices of third parties. To learn about the personal data practices of third parties, please visit their respective privacy notices.

Updates to This Privacy Notice

We may update this Privacy Notice from time to time. When we make changes to this Privacy Notice, we will change the date at the beginning of this Privacy Notice. If we make material changes to this Privacy Notice, we will notify individuals by email to their registered email address, by prominent posting on this website or our other platforms, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided.
